Go Transit Addendum

ADDENDUM TO THE MEMORANDUM OF UNDERSTANDING BETWEEN CPR AND TCRC RELATING TO GO TRANSIT OPERATIONS

Preamble:

This agreement is supplemental in nature, to the main agreement and all other articles contained therein will remain in effect, except those modified or otherwise noted through this agreement.

 

TERMS:

Article 1, is modified as follows;

1) Three working assignments will be established to man these trains, each working one

    (1) train each way per day. These assignments will be bulletined to operate

    Willowbrook to Willowbrook via Milton and Toronto in the morning with crews

    being transported  from Willowbrook to Milton. and Willowbrook to

    Willowbrook via Toronto and Milton at night with the crews being transported

     from Milton to Willowbrook.

 

NEW BUSINESS:

1a) Employees on these assignments will be paid 20 kilometers per tour of duty effective January 8, 2007, until January 7, 2009 (2-year term). Rates are in accordance with the collective agreement. 

2) Effective January 8, 2007, Don Yard located within the TTR will be used as an intermediate layover site.

a) GO Trains 154, 156, 158 will operate from Willowbrook to Willowbrook via Milton and Don Yard. Transportation will be provided from Don Yard to Willowbrook.

b) GO Trains 153, 155 and 157 will operate from Willowbrook to Willowbrook via Don Yard and Milton. Transportation will be provided from Willowbrook to Don Yard.  There are no changes to the existing starting times for GO Trains 153, 155 and 157.

d) Each employee operating GO Train 154 will be off duty by 09:20 hours.  In the event the crew is off duty subsequent to 09:20 hours, each employee traveling to Willowbrook will be paid a minimum of one hour at passenger rates; unless the crew has generated a claim under Article 4(c) of the Go Agreement.  In the event a claim has been generated under 4(c) of the Go Agreement, each employee traveling to Willowbrook will be off duty 40 minutes after departing Don Yard for Willowbrook (or) each employee traveling to Willowbrook will be paid one hour at passenger rates.  When time consumed is over one (1) hour, payment will be made on the minute basis each three (3) minutes to count as one (1)  mile.

e) Each employee operating GO Train 156 will be off duty by 09:30 hours.  In the event the crew is off duty subsequent to 09:30 hours, each employee traveling to Willowbrook will be paid one hour at passenger rates; unless the crew has generated a claim under 4(c). In the event a claim has been generated under 4(c), each employee traveling to Willowbrook will be off duty 40 minutes after departing Don Yard for Willowbrook (or) each employee traveling to Willowbrook will be paid  one hour at passenger rates. When time consumed is over one (1) hour, payment will be made on the minute basis (each three (3) minutes to count as one (1)  mile.

f) Each employee operating GO Train 158 will be off duty by 09:40 hours.  In the event the crew is off duty subsequent to 09:40 hours, each employee traveling to Willowbrook will be paid one hour at passenger rates; unless the crew has generated a claim under 4(c).  In the event a claim has been generated under 4(c), each employee traveling to Willowbrook will be off duty 40 minutes after departing Don Yard for Willowbrook (or) each employee traveling to Willowbrook will be paid one hour at passenger rates. When time consumed is over one (1) hour, payment will be made on the minute basis (each three (3) minutes to count as one (1)  mile.

This agreement is without precedent or prejudice to the position of either party concerning matter of a similar nature.  All other applications, clauses and conditions will be governed as per the main agreement between Canadian Pacific Railway and the TCRC – Locomotive Engineers and Trainpersons, regarding Go Operations.  

This agreement is signed the 5th day of January, 2007, for implementation on the 8th day of January, 2007.
